In recent years, large-scale work has been carried out in the country to strengthen the engineering of state borders, strengthen the material and technical base of the border troops and ensure national security.

At the same time, it was noted that new manifestations of transnational crime, in particular the construction of underground tunnels across the State border and their illegal use, necessitate further improvement of current legislation.

During the discussion, it was noted that between 2016 and 2025, 12 illegal underground tunnels were identified at the state border. Attempts to illegally import significant volumes of goods, currency, and other valuables into the country were recorded using them. It was emphasized that such facts pose a serious threat to the integrity of the state border, economic security, and national interests.

The law establishes criminal liability in the Criminal Code specifically for the construction and operation of illegal tunnels and other underground infrastructure facilities across the state border, as well as for organizing or financing such activities. The penalties for crossing the state border or committing smuggling crimes using such illegal structures are also strengthened. In addition, the Law also reflects the principle of humanity. In particular, it is provided that a person who has committed an act of this kind for the first time may be exempted from criminal liability if they voluntarily report the illegal tunnel to the state authorities or actively assist in the investigation of the crime, and if their actions do not constitute another crime.

Furthermore, the amendments to the Criminal Procedure Code establish that preliminary investigative actions in crimes related to the construction and use of illegal underground tunnels across the state border are carried out by investigators from the State Security Service. This further expands the possibilities for the rapid detection and effective investigation of this type of crime.

During the discussion, senators noted that the Law serves as an important legal basis for strengthening the inviolability of the state border, increasing the effectiveness of the fight against transnational organized crime, ensuring national and economic security, and further strengthening peace and stability in the country.

The Law has been approved by the senators.
